1. Agreement to These Terms
Welcome to Talesbrew. These Terms of Service (“Terms”) are a legal agreement between you and Talesbrew Inc. (“Talesbrew,” “we,” “our,” or “us”), governing your access to and use of the Talesbrew mobile application and all related services (collectively, the “Platform”).
By creating an account or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
To use Talesbrew, you must:
- Be at least 18 years of age
- Be legally capable of entering into a binding agreement
- Not be prohibited from using the Platform under applicable law
- Not have had a previous account terminated by Talesbrew for violations of these Terms
By creating an account, you represent and warrant that you meet all of the above requirements. If we discover that you do not, we reserve the right to terminate your account immediately.
3. Your Account
3.1 Account Creation
You must provide accurate, current, and complete information when registering. You are responsible for keeping your account information up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at connect@talesbrew.com if you suspect unauthorized access to your account.
3.3 One Account Per Person
You may only maintain one active account. Creating duplicate or fake accounts is prohibited and may result in termination of all associated accounts.
4. Acceptable Use
Talesbrew is a platform for genuine human connection. You agree to use it in good faith and in compliance with these Terms and all applicable laws.
4.1 You May Not:
- Impersonate any person or entity, or misrepresent your identity or affiliation
- Upload photos or content that are not of you or that you do not have the right to use
- Harass, threaten, intimidate, stalk, or harm any other user
- Use the Platform for any commercial solicitation, advertising, or spam
- Send unsolicited bulk messages or repeatedly contact users who have asked not to be contacted
- Share explicit, sexually graphic, or pornographic content
- Post content that is hateful, discriminatory, or promotes violence toward any individual or group
- Use the Platform to facilitate illegal activities, including the buying or selling of illegal goods or services
- Scrape, copy, or extract data from the Platform using automated means
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the Platform
- Interfere with or disrupt the Platform’s infrastructure, servers, or networks
- Create or distribute malware or any code designed to harm the Platform or its users
- Circumvent or attempt to circumvent any safety or moderation features
4.2 Real-World Safety
Talesbrew is designed to bring people together in person. You acknowledge that in-person meetings carry inherent risks and that Talesbrew does not conduct background checks on users. You are solely responsible for your safety when meeting other users. We encourage you to meet in public places, tell someone where you are going, and trust your instincts.
5. Content You Post
5.1 Your Responsibility
You are solely responsible for any content you post, share, or transmit through the Platform, including profile information, messages, event descriptions, group content, and photos.
5.2 License to Talesbrew
By posting content on the Platform, you grant Talesbrew a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, display, reproduce, and distribute that content solely for the purpose of operating and improving the Platform. This license ends when you delete the content or your account, except where the content has been shared with others who have not deleted it.
5.3 Content Standards
All content must comply with our Community Guidelines, which are incorporated into these Terms by reference. We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful to users or the community.
5.4 No Endorsement
Talesbrew does not endorse any content posted by users. Views expressed by users are their own and do not reflect the views of Talesbrew.
6. Events and Groups
6.1 Organizer Responsibility
If you create an event or group on Talesbrew, you take on responsibility for that activity. You represent that:
- The event or group complies with all applicable laws and regulations
- You have any necessary permits or permissions required to host the activity
- The information you provide about the event or group is accurate and not misleading
6.2 Attendance
Attendance at any event arranged through Talesbrew is entirely at your own risk. Talesbrew is a platform that facilitates discovery and connection — we are not a party to any agreement between attendees and organizers, and we are not responsible for any events that take place on or off the Platform.
6.3 Location Privacy
Event organizers may choose to reveal the exact address of an event only to confirmed attendees. By attending an event, you agree to keep location details shared in that context confidential and not to redistribute them without the organizer’s consent.
6.4 Group Administration
Group admins are responsible for moderating their group’s content and ensuring members comply with these Terms. Talesbrew may remove groups that violate these Terms and may revoke admin privileges where necessary.
7. Talesbrew Pro Subscription
7.1 What Is Included
Talesbrew Pro is a paid subscription that unlocks the ability to create events and groups, access analytics, and receive a Pro badge on your profile. Features included in Pro are subject to change with reasonable notice.
7.2 Billing
Talesbrew Pro is billed at $14.99 per month. By subscribing, you authorize us to charge your chosen payment method on a recurring monthly basis until you cancel. All charges are in US dollars.
7.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features through the end of the paid period.
7.4 Refunds
All subscription charges are non-refundable except where required by applicable law. If you believe you were charged in error, contact us at connect@talesbrew.com within 30 days of the charge.
7.5 Price Changes
We may change the price of Talesbrew Pro with at least 30 days’ notice. If you do not cancel before the new price takes effect, your subscription will renew at the new rate.
8. Intellectual Property
8.1 Our Property
Talesbrew and its licensors own all rights to the Platform, including its design, code, branding, logos, and content created by Talesbrew. Nothing in these Terms grants you any rights in the Platform beyond the limited license to use it as described here.
8.2 Feedback
If you provide us with feedback or suggestions about the Platform, you grant us the right to use that feedback without any obligation to compensate you.
8.3 Copyright Complaints
If you believe that content on the Platform infringes your copyright, please send a notice to connect@talesbrew.com with the following: a description of the work you claim is infringed, the URL where the infringing content appears, your contact information, and a statement that you have a good faith belief the use is not authorized.
9. Privacy
Your privacy matters to us. Our Privacy Policy, available at talesbrew.com/privacy, explains how we collect, use, and protect your information. By using the Platform, you agree to our data practices as described in that policy.
10. Third-Party Services
The Platform may contain links to third-party services or integrate with third-party tools. Talesbrew is not responsible for the content, privacy practices, or terms of any third-party service. Your use of those services is governed by their own terms.
11. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Talesbrew does not warrant that:
- The Platform will be uninterrupted, error-free, or secure
- Any content or information on the Platform is accurate or reliable
- Defects will be corrected
- The Platform is free of viruses or other harmful components
Talesbrew does not conduct background checks on users and makes no representations about the character, identity, or intentions of any user.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TALESBREW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TALESBREW IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Talesbrew and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses — including reasonable legal fees — arising out of or related to your use of the Platform, your content, your violation of these Terms, or your violation of any third party’s rights.
14. Termination
14.1 By You
You may delete your account at any time through Settings. Upon deletion, your profile will be removed from the Platform within 30 days, subject to our data retention practices described in the Privacy Policy.
14.2 By Talesbrew
We may suspend or terminate your account at any time, with or without notice, if we determine that you have violated these Terms, pose a safety risk, or for any other reason at our sole discretion. Termination for cause is immediate and does not entitle you to a refund.
14.3 Effect of Termination
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will do so, including Sections 5, 8, 11, 12, 13, and 15.
15. Dispute Resolution
15.1 Informal Resolution
Before filing any formal claim, you agree to contact us at connect@talesbrew.com and give us 30 days to resolve the issue informally.
15.2 Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law provisions.
15.3 Jurisdiction
Any disputes not resolved informally shall be brought exclusively in the state or federal courts located in Hudson County, New Jersey. You consent to the personal jurisdiction of those courts.
15.4 Class Action Waiver
To the extent permitted by law, you agree that any dispute resolution will be conducted on an individual basis and not as a class action, consolidated action, or representative proceeding.
16. General Provisions
16.1 Entire Agreement
These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Talesbrew regarding the Platform.
16.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
16.3 No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
16.4 Assignment
You may not assign or transfer any rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely.
16.5 Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you via the app or by email at least 14 days before the changes take effect. Continued use of the Platform after the effective date constitutes your acceptance.
